Personal data means any information about an identified or identifiable natural person; an identifiable natural person is a natural person who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, identification number, location data, online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.

II. Sources and Categories of Processed Personal Data

1. The controller processes the personal data that you have provided to them or the personal data that the controller has obtained based on the fulfillment of your order.

2. The controller processes your identification and contact data and data necessary for the fulfillment of the contract.

III. Legal Reason and Purpose of Personal Data Processing

1. The legal reason for processing personal data is

  • the performance of a contract between you and the controller according to Art. 6(1)(b) GDPR,
  • the legitimate interest of the controller in providing direct marketing (especially for sending commercial communications and newsletters) according to Art. 6(1)(f) GDPR,
  • your consent to the processing for the purposes of providing direct marketing (especially for sending commercial communications and newsletters) according to Art. 6(1)(a) GDPR in conjunction with § 7(2) of Act No. 480/2004 Coll., on certain information society services if no order for goods or services has been made.

 2. The purpose of processing personal data is

  • to process your order and exercise rights and obligations arising from the contractual relationship between you and the controller; when placing an order, personal data are required which are necessary for the successful processing of the order (name and address, contact), the provision of personal data is a necessary requirement for concluding and fulfilling the contract, without the provision of personal data it is not possible to conclude or fulfill the contract by the controller,
  • to send commercial communications and perform other marketing activities.

 3. The controller does not / does perform automated individual decision-making within the meaning of Art. 22 GDPR. You have given your explicit consent to such processing.

IV. Data Retention Period

1. The controller retains personal data

  • for the period necessary to exercise rights and obligations arising from the contractual relationship between you and the controller and to assert claims from these contractual relationships (for a period of 15 years from the termination of the contractual relationship).
  • until the consent to the processing of personal data for marketing purposes is withdrawn, but no longer than …. years, if personal data are processed on the basis of consent.

 2. After the expiration of the personal data retention period, the controller deletes the personal data.

V. Recipients of Personal Data (Controller’s Subcontractors)

1. The recipients of personal data are individuals

  • involved in the delivery of goods / services / execution of payments based on a contract,
  • providing e-shop operation services (Shoptet) and other services related to the operation of an e-shop,
  • providing marketing services.

 2. The controller does not / does intend to transfer personal data to a third country (to a country outside the EU) or an international organization. The recipients of personal data in third countries are mailing service providers / cloud service providers.

VI. Your Rights

1. Under the conditions set out in the GDPR, you have

  • the right to access your personal data according to Art. 15 GDPR,
  • the right to rectify personal data according to Art. 16 GDPR, or to restrict processing according to Art. 18 GDPR,
  • the right to erasure of personal data according to Art. 17 GDPR,
  • the right to object to processing according to Art. 21 GDPR, and
  • the right to data portability according to Art. 20 GDPR,
  • the right to withdraw consent to processing in writing or electronically to the address or email of the controller specified in Art. III of these conditions.

 2. You also have the right to file a complaint with the Office for Personal Data Protection if you believe that your right to personal data protection has been violated.

VII. Personal Data Security Conditions

1. The controller declares that it has taken all appropriate technical and organizational measures to secure personal data.
